Bicycle Rental Waiver, Release of Liability & Assumption of Risk Agreement

This waiver is a legal document that affects your rights. By completing and submitting this form, the Renter acknowledges and accepts all risks associated with the rental and use of bicycles, including electric and non-electric bicycles, and related equipment (the “Equipment”), and agrees to release Sicamous E-Bike Co. (the “Company”), and their respective owners, officers, employees, contractors, volunteers, and affiliates, from any and all liability to the fullest exteBicyclent permitted by law.

1. DEFINITIONS

• The “Company” refers to Sicamous E-Bike Co., the owner and supplier of the Equipment.

• The “Equipment” includes bicycles (electric and non-electric), accessories, components, and safety gear such as helmets, locks, batteries, and chargers.

• The “Renter” refers to the individual signing this Agreement and includes any person to whom the Renter provides access to, permits to use, or allows to operate the Equipment.

• The “Agreement” refers to this Rental Agreement, Waiver of Liability, Release of Claims, and Assumption of Risk, including all terms, conditions, acknowledgments, and authorizations contained herein.

2. ASSUMPTION OF RISK

The Renter acknowledges that operating a bicycle, including an electric bicycle, involves inherent risks, dangers, and hazards, including but not limited to:

• Sudden acceleration due to electric assist.

• Increased speeds compared to traditional bicycles.

• Brake failure or reduced braking efficiency.

• Battery or electrical system malfunction.

• Loss of control due to terrain, weather, or rider error.

• Interaction with motor vehicles on public roads.

• Trail hazards such as loose gravel, sand, steep descents, and obstacles.

• Collisions with objects, people, or vehicles.

• Serious injury, disability, or death.

The Renter voluntarily, knowingly, and expressly assumes all such risks, whether or not specifically listed, and regardless of whether such risks arise from negligence.

3. WAIVER & RELEASE OF LIABILITY

In consideration for being permitted to rent and use the Equipment, the Renter hereby releases, waives, discharges, and holds harmless Sicamous E-Bike Co., including their respective owners, officers, employees, contractors, volunteers, and affiliates, from any and all liability, claims, demands, actions, or causes of action of any kind, whether in law or equity, arising out of or related to:

• Any injury (including death) suffered by the Renter.

• Any loss of or damage to personal property.

• Any incident, accident, or event occurring during or as a result of the rental, operation, or use of the Equipment.

This release applies whether such injury, loss, or damage is caused by ordinary negligence, equipment malfunction, environmental conditions, or any other cause, to the fullest extent permitted by the laws of British Columbia and Canada.

4. EQUIPMENT USE & RESPONSIBILITIES

The Renter agrees to:

• Operate the Equipment in accordance with all applicable laws in British Columbia.

• Use the Equipment only on designated bike trails, permitted public roads, and approved riding areas.

• Not operate the Equipment on highways, restricted areas, or private land without permission.

• Not allow unauthorized users to operate the Equipment.

The Renter accepts full responsibility for the Equipment during the rental period and agrees to return it in the same condition, subject to normal wear and tear. The Renter is fully responsible for any theft, loss, or damage to the Equipment, regardless of circumstance.

5.Minimum Age Requirement / Minors

The Renter acknowledges and agrees that the minimum age to rent a bicycle independently is eighteen (18) years of age or older.

Any person under eighteen (18) years of age may not rent or operate the Equipment unless accompanied at all times by a parent or legal guardian, and the parent/legal guardian must complete and sign this Agreement on the minor’s behalf and assumes full responsibility and liability for the minor’s actions, supervision, and use of the Equipment.

6. MANDATORY SAFETY GEAR

Helmet use is mandatory under the laws of British Columbia and must be worn at all times while operating the Equipment. The Renter acknowledges that:

• Helmets and safety gear may be provided by the Company.

• If the Renter declines to use provided safety gear or chooses to use their own, they assume full responsibility for any resulting injury, loss, or damage.

Failure to wear a helmet or comply with safety requirements constitutes a material breach of this Agreement and may result in immediate termination of the rental without refund.

7. CREDIT CARD AUTHORIZATION

The Renter authorizes Sicamous E-Bike Co. to charge any credit card provided for the following, without further notice or consent:

• Security or damage deposits.

• Costs related to damage, loss, theft, recovery, or excessive cleaning.

• Late return fees or unauthorized usage charges.

• Ongoing rental charges if the Equipment is not returned on time.

This authorization remains valid for up to thirty (30) days following the end of the rental period or until all amounts owing under this Agreement have been paid in full.

8. HEALTH & FITNESS DECLARATION

The Renter represents and warrants that they are physically and mentally fit to safely operate the Equipment. The Renter confirms that:

• They have not been advised by a medical professional to avoid operating or riding a bicycle.

• They do not suffer from conditions such as seizures, severe respiratory illness, cardiovascular disease, or any other impairment that could place themselves or others at risk.

9. ALCOHOL & SUBSTANCE USE

The Renter agrees not to operate the Equipment while under the influence of alcohol, cannabis, illegal drugs, or any medication or substance that may impair judgment, coordination, or ability. Any violation of this clause constitutes a material breach of this Agreement and may result in immediate termination of the rental without refund.

10. CANCELLATION & REFUND POLICY

The Renter acknowledges and agrees to the following cancellation terms:

• 30+ days prior to rental date: Full refund, less any processing fees.

• 14–29 days prior: 50% refund or credit toward a future booking.

• Less than 14 days or no-show: No refund or credit.

11. LEGAL JURISDICTION

This Agreement shall be governed exclusively by the laws of the Province of British Columbia and the laws of Canada applicable therein. Any disputes shall be resolved in the courts of British Columbia.

 ACKNOWLEDGEMENT & SIGNATURE

By signing below or submitting this form electronically, I acknowledge that I have read, fully understood, and voluntarily agree to the terms of this Waiver and Release of Liability. I confirm that:

• I am at least 18 years of age, or I am the parent/legal guardian of a minor rider and accept full responsibility for their use of the Equipment.

• I voluntarily assume all risks associated with the rental and use of the Equipment.

• I accept full financial responsibility for any damage to or loss of the Equipment.
